Terms of Service

This document is an electronic record in terms of the Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

The brand ShipLive is owned and operated by Aipex Worldwide (OPC) Pvt Ltd (hereinafter referred to as "Company," "Aipex," "we," "us," or "ShipLive").

1. Eligibility: You must be 18 years or older to use this Service.
2. Signup Information: You must provide your full legal name, current business address, a valid Email ID (which serves as your primary identifier), and any other information required to complete the signup and KYC process.
3. Security: You are responsible for keeping your password secure. ShipLive/Aipex Worldwide (OPC) Pvt Ltd cannot and will not be liable for any loss or damage resulting from your failure to maintain the security of your account and password.
4. Legal Compliance: You may not use the ShipLive service for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of India.
5. Content Responsibility: You are responsible for all activity and content (data, graphics, photos, links, and weight evidence) that is uploaded under your ShipLive account.
6. Malware: You must not transmit any worms, viruses, or any code of a destructive nature.
7. Termination: A breach or violation of any of the Account Terms, as determined in the sole discretion of ShipLive, will result in an immediate termination of your services.

1. Acceptance: You must read, agree with, and accept all of the terms and conditions contained in this User Agreement and the Privacy Policy before you may become a member of ShipLive.
2. Right to Refuse: We reserve the right to modify or terminate the Service for any reason, without notice at any time. We reserve the right to refuse service to anyone for any reason at any time.
3. "As Is" Basis: Your use of the Service is at your sole risk. The Service is provided on an ”as is“ and ”as available“ basis without any warranty or condition, express, implied, or statutory.
4. No Warranty: ShipLive does not warrant that the service will be uninterrupted, timely, secure, or error-free, or that the results obtained from the use of the service will be accurate or reliable.
5. Data Transmission: You understand that your Content (not including sensitive payment gateway information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
6. Content Removal: We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
7. Limitation of Liability: You expressly understand and agree that ShipLive/Aipex shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use the service.
8. Indemnity: You agree to indemnify and hold us and (as applicable) our parent company Aipex Worldwide (OPC) Pvt Ltd, subsidiaries, affiliates, partners, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
9. Support: Technical support is only provided to paying account holders and is primarily available via email and, if agreed upon earlier, via phone and our internal request ticketing system.
10. Non-Exploitation: You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by ShipLive.
11. Anti-Abuse: Verbal or written abuse of any kind (including threats of abuse or retribution) of any ShipLive customer, employee, member, or officer will result in immediate account termination.
12. IP Rights: We do not claim any intellectual property rights over the material you provide to the ShipLive service. By uploading images and descriptions to the ShipLive platform, you agree to allow us to display and store them and review all content submitted.
13. Waiver: The failure of ShipLive to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right.
14. Keyword Restrictions: You shall not purchase search engine or other pay-per-click keywords (such as Google AdWords), or domain names that use "ShipLive" or "Aipex" trademarks and/or variations and misspellings thereof.

1. Terms: Depending on the payment term decided with ShipLive, the merchant has to pay on pre-decided monthly, quarterly, half-yearly, or yearly terms.
2. Timeline: The merchant must pay within 7 days from the date of the Invoice or risk the immediate suspension/termination of the account and shipping services.
3. Taxes: All fees are exclusive of all state and central taxes, GST, or other charges now in force or enacted in the future (“Taxes”).
4. No Refunds: No refunds shall be provided for subscription plans or credited wallet balances upon termination for breach of terms.

1. Price Changes: Prices for using ShipLive are subject to change upon 14 days' notice. Such notice may be provided at any time by posting the changes to the ShipLive site or via a dashboard announcement.
2. Modification of Service: ShipLive reserves the right at any time to modify or discontinue the Service (or any part thereof) with or without notice.

1. Data Deletion: Once your account is cancelled, all of your Content and historical logistics data will be immediately deleted from the Service. Deletion is final and irreversible.
2. Fraud: Without limiting any other remedies, ShipLive/Aipex may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance, or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the platform or shipping network.

You shall not, directly or indirectly, offer, trade, or attempt to ship any item prohibited or restricted under any applicable law, rule, or regulation. Aipex Worldwide (OPC) Pvt Ltd does not permit the shipping or hosting of the following:

• Securities: Shares, bonds, debentures, or financial instruments.
• Wildlife: Living or dead creatures, or any part of an animal (skins, horns, feathers, eggs, etc.) restricted under the Wildlife Protection Act, 1972.
• Weapons: Firearm parts, ammunition, or weapons of any description.
• Controlled Substances: Liquor, tobacco products, drugs, psychotropic substances, narcotics, or unapproved medicines.
• Sensitive Items: Religious artifacts or items likely to affect the religious sentiments of any person.
• Heritage: "Antiquities" and "Art Treasures" in violation of the Antiquities and Art Treasures Act, 1972.
• Telecommunication: Used cellular phone SIM Cards.

Furthermore, as a Merchant, you agree to adhere to your own terms of use and privacy policy governing your conduct with your own customers.
